Attorney General Tim Griffin on Wednesday announced he would join with 20 other states in a lawsuit challenging new federal regulations on firearm sales.

Griffin, who is co-leading the federal lawsuit with the attorney general from Kansas, said the federal rule is “not even close to legal.” Griffin said the process of how the Department of Justice and the Bureau of Alcohol, Tobacco, Firearms and Explosives have gone about proposing changes is illegal. When asked about the Bipartisan Safer Communities Act of 2022 — the legislation Congress passed and what the rule will amend — Griffin dismissed its relevance.

“I think that this is a combination of election year politics, of frustration [and] not getting what you want through Congress that would do it another way,” Griffin said. “I think it involves catering to people in his [President Biden’s] base who are demanding it.”

The Biden administration finalized the rule to close the gun show loophole on April 11. The rule has been touted as a significant step forward in gun regulation as it closes the opportunity for people to sell firearms online or other informal venues without completing background checks on purchasers.

Additionally, it would require more people who sell firearms to seek a federal license. As it exists now, people who don’t claim selling firearms as their primary source of income have been exempt from obtaining a Federal Firearms License. With the gun show loophole closed, anyone who sold a gun for profit would be required to register for a license.

A senior White House official told a States Newsroom reporter in April that the Biden administration is confident the rule will survive any legal disputes.

On the contrary, Griffin said Tuesday, “I think we make a really strong case that this is not even close to legal.”

The suit asks the court to postpone the rule and declare that it violates the Second Amendment of the U.S. Constitution. It also seeks an injunction against the Department of Justice and the ATF from enforcing the rule.

Though not explicitly mentioned in the lawsuit, Griffin referenced the recent fatal shooting of Little Rock airport executive Bryan Malinowski. On the morning of March 19, ATF agents arrived at Malinowski’s home in West Little Rock to serve a search warrant.

According to the agency, Malinowski shot at the officers and the federal agents returned fire. ATF agents shot Malinowski in the head, and he died days later in a hospital. Following his death, court documents showed ATF was conducting a raid on the allegations that Malinowski was illegally selling firearms, often at gun shows and other informal settings. Agents seized dozens of guns from Malinowski’s house.

About a month after the raid, Griffin and Republican members of the Arkansas Legislature separately called for ATF to release body camera footage from March 19. It was later revealed agents were not wearing cameras, an apparent violation of the agency’s policy.

Prosecuting Attorney Will Jones is currently investigating the Malinowski shooting.

Asked if Griffin thought the outcome of the raid at Malinowski’s house would have been different if Malinowski had a federal firearm license, he said he didn’t know enough about the case to confidently answer.

Following the press conference Wednesday morning, the attorney for Malinowski’s family, Bud Cummins, released a statement in support of the lawsuit.

“It doesn’t matter if you support more gun control, or you fall on the side of more 2nd amendment liberty,” Cummins wrote. “Everyone must agree only Congress can pass laws, and that none of us should fear prison over rules that are vague and impossible to understand. That is what the Attorney General’s lawsuit announced today is all about.”

Other states joining the lawsuit are Iowa, Montana, Alabama, Alaska, Georgia, Idaho, Indiana, Kentucky, Missouri, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, Tennessee, Virginia, West Virginia, and Wyoming.

Possession of swords was forbidden by the Romans in the Holy Land and yet Jesus said his guys needed to sell their cloaks and buy a sword. Remember how Peter pulled out his “concealed carry” blade and cleanly lopped off the ear of the top pol’s servant. Majority of church denominations are social centers where people go for social and business interactions. Many churches now are are woke/liberal. Pastors have little knowledge of gov. corruption or the push for global gov. They are there to collect money. Doctrinal studies is rarely taught incl prophecy in old and new T. Home church and/or meeting in small groups for fellowship is ideal. Some I know meet up on ZOOM.

If the state’s sovereignty is real they need to just ignore Federal demands, and let that be the end of it.

The Constitution is interpreted or should be interpreted by contract law because that’s exactly what it is and in contract law the states are the superior party.

The 14th amendment that the republican’ts brag about enacting was the basis for overturning the principle of state sovereignty.. Legalistic advances are mostly based on “interpretation” of the constitution; a document written in very plain, spare English (at least before Lincoln’s war) to avoid misinterpretation. “Interpretations” are, in effect, the translation into Martian of laws written in English .

The DVers don’t understand that the government uses electronic warfare. People don’t seem to be able to look beyond guns and realize that the battlefield has changed, and drastically at that. Our government is way beyond WW2 weaponry. The public at large is not sufficiently trained in using firearms, let alone knowing how to fight space-age weaponry.

Americans aren’t even taught critical thinking for the most part. Wouldn’t it therefore be dangerous for most Americans to own guns? They’d perhaps be better off signing agreements of surrender during an invasion, and benefit thereby materially speaking and perhaps their lives would be spared. Many of those militia types put themselves in their isolationist positions by permitting fewer and fewer to be trained in the needful ways of resistance. However, they also tended to make government and the Constitution a god, i.e., postulating their right to vote, “just wanting to be left alone” (capitalist privilege) and outwardly extolling republican virtues at the expense of the country, claiming freedom of association.

Many people have already experienced the emotions of anger, disgust and disdain over realizing the country was given to outside entities, and doesn’t belong to those within its territories and hasn’t for many generations. Further the inability to resolve the entanglements the oligarchic class have with the elites that are the basis for many of these infringements means that it’s merely a waiting with anticipation for the next logical course of events, namely the multi-force invasion of the country. Most everything else has been taken over. This wasn’t so much an abdication by individuals, but rather the allowing of the institutions, workplace, military, economy and religious sectors to be usurped. That’s historically how countries get taken over.

Any law restricting the ownership or carrying of arms is an infringement of that right. How any judge can read the 2nd Amendment and fail to see that any law that places any restriction or disability on the RKBA is an infringement, is stupid (at best) or, more likely, has an evil intention for ruling in favor of such a law.

Most Americans don’t understand Communism, such as many farmers apparently. They may call it government overreach, but they’ll tolerate it as they have for decades because it’s not presented to them as communism or explained or made realizable as part of a larger agenda. If farmers wanted to behave smartly they’d start building their power bases up such as by opening up their land for people to live at no expense (then they’d have workers). They should offer food crops to the poor and those in need and start showing people that they don’t have to rely on the state but can assist in their own sustaining efforts by locales by offering small helps in exchange for food. They’re losing much of what they have anyway, but it shouldn’t have taken them so long to find resolutions. What they’ve been doing doesn’t work. They might try direct action such as initiatives of working with those in the ghettos in transforming living environments. That would be radical. This was one of the biggest achievements of American education, to keep people from really understanding and grasping communism, while hyping up the rhetoric and frenzy about it with select examples from history.

No such thing as a “gun show loophole”. They just want to close-off the private purchase and transfer of firearms. The Feds are not authorized to have any firearm laws at all. All gun laws are illegal according to the Constitution.
Maybe it would be more productive to close the government loophole and eliminate all govt interference in our affairs completely.
It’s the govt posing the worst danger to this country, not the guns. Want to ban something, ban the govt.

With regard to selling things such as not being able to set up a table for instance at or a designated place near where one lives to sell items that aren’t needed anymore, or personal items to help pay for expenses is really a financial liability. The public space is supposed to be available to the public, but it’s much like how free speech is contained, self-censored, or deleted on various internet channels, or people speak in half-words, or use phraseology/slang to avoid penalties. Anything to do with generating or earning money is highly regulated. It’s actually furthering the repression by content creators staying on these platforms, as well as the commenters.

As a young adult I saved money by wearing clothing I purchased at yard sales. For the government to attempt to regulate or tax used goods is extortion. The goods have already been taxed at the store. The mom that held the yard sale earned some milk money by selling me the used clothing. I saved my hard earned and over taxed wages for those things I needed. If I were afraid of my neighbors dog and, the mom was selling a gun, I would be grateful to her for selling her gun to me. By the time animal control could get to my home an animal could harm me. Dogs do bite. Don’t tell me a paper law will protect me from that.

Why can’t a state ban the ATF from operating in that state? Declare the ATF an illegal usurpation of the 2nd Amendment, operating outside the law, and arrest ATF personnel when they are identified and apprehended within that state? The ATF is essentially a rogue political operation.

Theoretically, any state could (and many should) do that. But there isn’t a single state with enough politicians with the brains and balls to attempt that. They are mostly all Uniparty career politicians who are much more interested in dominating their citizens, getting rich, or getting reelected than asserting the constitutional rights of their state. And the few politicians who might think about challenging the federal government are probably hesitant because of the precedent that the War of Northern Aggression set.

Pick pick pick away a little at a time the communist way two steps forward one step back and in the long run they get what they want a country disarmed then the communists can what ever the hell they feel like .This is what the communist Joe the Sniff Bribeme is after total disarm the country the only thing is will the US go completely broke first. I would not be at all surprised if these shootings that the communists fill their drawers about are not all put up deals by the communists themselves.

Yes, it’s pretty obvious once you’ve seen the first example. It’s kinda like hunting arrowheads: once you find the first one, your mind can sort the shapes correctly and you begin to identify them more easily. The big difference is that finding an arrowhead gives me a good feeling, while noticing a communist intention causes a different feeling.
